PORTUGAL: EU Posted Workers Directive effective immediately

Portugal’s implementation of the EU Directive on the posting of foreign workers has immediately come into effect. Employers sending expats to Portugal must now notify the Authority for Labor Conditions (ACT), and should therefore consider the following requirements according to the 2014 EU Directive:    


Employers are required to notify the ACT at least 48 hours before the start date of their posted workers. All the accompanied information, for example the posted worker’s identification, assignment duration and all relevant addresses, must be submitted via official forms. 


Both the sending and hosting company departments must store copies of employment contracts, proof of payments and pay-slips, and records of working time. All the documents must either be in Portuguese or attached with a sworn and certified translation.  

How does this affect the client?

Companies sending expats to Portugal are advised to take the new requirements into account immediately and contact their immigration specialists in case of uncertainties regarding the new application conditions.
