SWEDEN: New regulations for recalls of work permit

Effective 1 December 2017, the Swedish government has proposed some changes to the Aliens Act. The Migration Agency does no longer need to recall a temporary residence permit for work, if the employer has corrected shortcomings that were previously grounds for recall.

Additionally, there is a law proposition to the Parliament suggesting that foreign nationals working in Sweden should no longer be deported if an employer unintentionally makes minor mistakes related to the work permit conditions. This will apply even if the mistake was detected after the work permit has expired, or if the Swedish Migration Agency detected the mistake. This is proposed to be implemented by 1 July 2018 the latest.

How does this affect the client?

The new regulation is a positive development as it allows employers to correct mistakes related to insurances coverage which currently often result in unnecessary deportations.
