UNITED KINGDOM: Changes to Immigration Rules

As per 7 December the Government in the UK has published a statement of changes regarding immigration rules in particular with reference to Tier 1 and Tier 2 visas.

Tier 1 (Exceptional Talent)

The number of available Tier 1 (exceptional talent) visas will increase from 1000 to 2000 and after 3 years holders of a Tier 1 exceptional talent visa will be permitted to apply for ‘Settled Status’.

Tier 2 (General)

In some cases students will be able to switch their visa types to a Tier 2 visa as soon as they have completed their study and before receiving their final results, previously this was not possible. There will also be amendments regarding applications for settled status from Tier 2 migrants; they will not longer have to have been continuously employed in the qualifying period for settled status application.

Additionally, the Government would like to introduce an electronic system with regards to entry endorsement. Currently this is done with the passport of the applicant, but the aim is for this to be done completely electronically.

How does this affect the client?

Employers should ensure that their processes are updated to take into account these changes.
