UNITED STATES: Increase in premium processing fee by USCIS

The U.S. Citizenship and Immigration Services (USCIS) has announced an increase in the premium processing fee for Form I-129, Petition for a Nonimmigrant Worker, and Form I-140, Immigrant Petition for Alien Workers.

Starting 1 October, the premium processing fee will increase to $1,410 which is a 15% increase on the current amount of $1,225. This is the first increase to take place since 2010.

Prior to announcing the increase, the USCIS already announced to extend its premium processing suspension until 19 February 2019 and to broaden the current suspension beginning 11 September. By broadening the current suspension, it will cover most H-1B petitions, including transfer and amended petitions.

How does this affect the client?

Employers are recommended to budget in the processing fee increase and are reminded that the previously announced premium processing suspension will be longer and broader than initially expected.
