UNITED STATES: Lottery results for H-1B visa

The H1B visa is an employment-based visa for temporary workers. The employer must offer a position in the US and apply for the applicant’s H1B visa petition with the US Immigration Department.

In April the USCIS received over 200,000 H-1B cap petitions in the first week. The U.S. Citizenship and Immigration Services (USCIS) has announced that all H-1B cap-subject petitions for fiscal year 2020 have now been selected in the lottery, which is capped at 65,000.

Petitions that fall under the U.S. advanced degree exemption, which gives advanced degree holders an advantage, have also been selected, capped at 20,000.

How does this affect your organisation?

Employers should keep an eye out for the following:

•  Receipts for petitions that were selected

•  H-1B cap petitions, along with their filing fees, that are being returned to those unselected. There is currently no timeframe for the return of unselected petitions.

•  Employers and employees should not contact the USCIS until they have received either of the above.
