UNITED STATES: Resumption of Premium Processing for Certain Cap-Exempt H-IB Petitions

The United States Citizenship and Immigration Services (USCIS) will resume premium processing for certain cap-exempt H-1B petitions effective immediately. 

How does this affect the client?

H-1B petitioners that are an institution of higher education, a non-profit related to or affiliated with an institution of higher education or a non-profit research or governmental research organization may be exempted from the cap for premium processing.

These eligible cap-exempt petitioners can effective immediately resume premium processing by filing Form I-907 for Form I-129. Form I-907 can be filed together with an H-IB petition or separately for a pending H-IB petition. 

Premium processing service allows for employers to request the USCIS to adjudicate H-IB petitions within 15 calendar days.
