SPAIN: Changing requirements for companies posting foreign workers to Spain

As of 29 May 2017, Spain has enforced the Posted Workers Enforcement Directive (2014/67/EU); changing requirements for companies when posting foreign workers to Spain. 

Newly implemented requirements include:

  • The Spanish Ministry of Employment and Social Security will implement an online notification portal; allowing companies to register the details of the foreign worker, prior to the start date of their assignment. This portal will be developed and implemented over the next few months. 
  • The notification of the upcoming assignment must include the contact details of the person or company responsible for communication with the Ministry.
  • All documents relevant to the posting of the foreign worker must be kept for 2 years following completion of the assignment. The documents required are: the employment contract, applicable work permits, salary slips and records of time worked. In addition, all documents must be made available in the Spanish language.

How does this affect the client?

Employers should be aware of the new regulations as of 29 May and should adapt their processes accordingly.
